No Speed Limits on Fwys

Ok, heres the story, the wife was backing down the drive into the street, no cars coming, good, moved out, turned to face direction to head off, while still in reverse and stationary, stupid women comes flying around corner doesnt look and hits the rear bumper adn tow bar, luckily no damage to our car, but she has broken indicator and headlight. Question? Who would be at fault and if they claim are we responsible, I say no cause she hit the back of us. Any Ideas?

You shouldn't be at fault if she has taken the corner at speed and hit you but who knows, anything can happen with these kinds of things. Should be fine though.

Thats what I said, but you know how women get. Should we claim for the scratches on the bumper as it could do with a respray and go her for the insurance, if we aint at fault then she pays her excess??

If any of the scrathes at all are as a result then i definetly would. If not you could still try, i doubt she could prove otherwise but i probably wouldn't.

i think if someone hits you (not if you reverse in to them) that it's their fault cause they didn't keep a safe distance... or generally if someone hits you from behind it's their fault.

nah if u are in reverse its ur fault my mum had that at a parkin lot she was reversing out of a park stoped and then felt someone hit her and the insurance said it was her fault because she was in reverse unless u say she was in drive ready to take off.

Say your car was in drive and you were ready to take off, then it will be her fault.

After working in insurance claims for 2 odd years, I'm sorry to say that you are held liable for being in reverse. Speed of other person is irrelevant because you can't prove it. Even if you say that you were in drive it is fair to assume that you did not leave enough romm to get out of your driveway.
Maybe the best you can get is apportioned blame but I doubt it. Cheers Scott |
