Default insurance claim

hi guys,

yesterday morning i was driving to the train station and waiting to turn left and waiting for the cars on the right to pass me, all of a sudden, BANG! a nissan nivara (dunno the spelling) with a bullbar : smashed into the back of my au xr6 : my question is, i have a rebel bar on the car since its the tickford model, i have called ford to get some prices and they do not make the kit anymore, so would they put a newer bar on or what? also i have the black altezza lights on the back but they work perfect with all globes working fine, could that be used against me in anyway since its an aftermarket part?

IMHO

If it was daylight the lights would be irrelevant to the actual accident, cop may give you ticket afterwards for illegal modification or something but the bloke that ran into you cant use it as an excuse.

If it was dark/bad visibility he might have a case

After market parts wont matter, do Altezzas taillights meet ADR? Probably half the older cars in Aus use after market headlights and indicators. If parts meet ADR's they would be fine.

Just as a point, I would have thought no matter what, any light has to be easier to see in the dark.

they will get a reco bar and fit it to your car..
when i smashed my ED-XR6 with a Custom bar they worked the parts and found a way to re-make the bar and included it in th claim....

the car eventually got written off as a week after i had a small bingle with slipry road and a fence someone hit it up the *** when it was parked... sending it flying into the neigbours yard and into their retaning wall.. sending that car to car heaven

The lights are not going to cause a problem...you were a statioanry vehicle and they smashed the back.
As fare a replacement of the bar goes, they will attempt to get a reco bar as alreay mentioned, if that is not possible the assesor should discuss options of one that will fit or even maybe offer a cash settlment which means they give you the cash and then its up to you to get fixed with no further comback on the insurer.
